Under the new immigration rules that came into effect on June 28,
2002, foreign workers who have arranged employment in Canada, and
apply for a Canadian Permanent Resident Visa under the Skilled Worker
category, qualify for valuable points of assessment. Applicants
holding a temporary work permit that is validated by the HRSDC or
an HRSDC-confirmed permanent offer of employment can obtain a maximum
of 10 points.
Introduction
Canada's policy
on foreign workers permits employers to recruit foreign workers
needed for the Canadian labour market. People who are neither Canadian
citizens nor permanent residents of Canada require written permission
from Human Resources Development Canada (HRSDC) before they
begin working in Canada. This written permission is called HRSDC
employment validation. Generally, these are issued only after a
Canadian immigration officer is satisfied that no qualified Canadians
or permanent residents of Canada are available to do the work. This
procedure is known as the "job validation process".
It can take
several weeks or months and could require the prospective Canadian
employer to advertise the position, interview applicants and demonstrate
valid reasons for rejection. Normally, application for an employment
authorization must be made at a Canadian embassy or consulate several
months before the anticipated travel date to commence employment
in Canada.
